Ajly Selection Terms & Conditions

Welcome to Ajly Selection. These Terms and Conditions (“Terms”) govern your access to and use of the Ajly Selection website, mobile application, social media pages, marketplace accounts, and related services (collectively, the “Platform”).

By accessing, browsing, purchasing from, or using the Platform, you agree to comply with these Terms and applicable laws of the Republic of the Philippines. If you do not agree with these Terms, please discontinue use of the Platform.

1. Eligibility and Account Registration

1.1 Users must provide accurate, complete, and updated information when creating an account or placing orders.

1.2 You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.

1.3 Ajly Selection reserves the right to suspend, restrict, or terminate accounts that contain false information, fraudulent activity, abuse, or violations of these Terms.

1.4 Users below eighteen (18) years old should use the Platform only with parental or guardian consent.

2. Products, Pricing, and Availability

2.1 All products are subject to availability.

2.2 Prices, promotions, discounts, and product listings may change without prior notice.

2.3 Ajly Selection reserves the right to correct pricing errors, inaccurate descriptions, stock availability errors, or typographical mistakes at any time.

2.4 Product colors, sizes, and appearance may slightly vary depending on screen settings, lighting, and manufacturing differences.

2.5 Some products sold by Ajly Selection may include ukay-ukay, thrifted, vintage, overruns, or pre-loved items. Customers acknowledge that such items may contain minimal signs of storage, handling, or previous use unless otherwise stated.

2.6 Ajly Selection makes reasonable efforts to inspect and disclose major defects or damages in product listings.

3. Orders and Payments

3.1 Submission of an order does not automatically guarantee acceptance. Ajly Selection reserves the right to reject or cancel orders due to:

• suspected fraud or unauthorized transactions

• pricing or listing errors

• unavailable inventory

• abuse of promotions

• violations of these Terms

3.2 Payments are processed through secure third-party payment providers. Ajly Selection does not store complete debit or credit card information.

3.3 By placing an order, you authorize the applicable payment provider to charge your selected payment method.

3.4 Official receipts, invoices, or electronic confirmations may be issued electronically in accordance with Philippine laws.

4. Cash on Delivery (COD) Policy

4.1 Customers selecting Cash on Delivery (COD) agree to accept and pay for confirmed orders upon delivery.

4.2 Ajly Selection reserves the right to restrict or remove COD access for customers with repeated:

• rejected orders

• fake bookings

• cancellations without valid reason

• unclaimed parcels

• abusive behavior toward riders or staff

4.3 Fraudulent orders or abuse of COD services may result in account suspension and possible legal action under applicable Philippine laws.

5. Shipping and Delivery

5.1 Delivery timelines are estimates only and may vary due to courier operations, weather conditions, holidays, public emergencies, customs processing, or other circumstances beyond reasonable control.

5.2 Customers are responsible for providing accurate shipping information. Ajly Selection shall not be liable for delays, failed deliveries, or losses caused by incorrect or incomplete information provided by the customer.

5.3 Risk of loss or damage transfers upon successful delivery and acceptance at the provided delivery address.

5.4 Customers must inspect orders upon receipt and promptly report damaged, missing, or incorrect items within the timeframe stated in the Refund Policy.

6. Unclaimed and Failed Deliveries

6.1 Orders returned due to refusal, recipient unavailability, or incorrect address may require additional shipping fees before redelivery.

6.2 Repeated failed deliveries may result in account restrictions or removal of COD privileges.

7. Pre-Orders and Made-to-Order Items

7.1 Pre-order and made-to-order items may require longer processing and delivery periods.

7.2 Estimated arrival dates are subject to supplier availability, shipping schedules, customs processing, and other external factors.

7.3 Cancellation of confirmed pre-orders may be subject to approval and applicable fees unless otherwise required by law.

8. Returns, Refunds, and Cancellations

8.1 Returns, refunds, replacements, and cancellations are governed by the Ajly Selection Refund Policy and applicable Philippine consumer laws.

8.2 Requests for refunds or replacements may require:

• proof of purchase

• photos or videos

• complete order information

8.3 Returned items must generally remain unused, unwashed, and in original condition with tags and packaging unless the item was defective or incorrectly delivered.

8.4 Refunds or returns may be denied for:

• misuse or improper handling

• customer-caused damage

• altered products

• fraudulent claims

• sanitary or hygiene concerns where applicable

8.5 Minor issues common to thrifted or ukay-ukay items, such as minimal fabric wear, slight discoloration, or small imperfections, may not qualify for refunds unless materially affecting usability.

8.6 Nothing in these Terms limits consumer rights granted under Philippine law.

9. Intellectual Property Rights

9.1 All Platform content including logos, graphics, text, images, product photos, videos, designs, and branding are owned by or licensed to Ajly Selection and protected under applicable intellectual property laws.

9.2 No content from the Platform may be copied, reproduced, distributed, modified, or commercially used without prior written permission.

10. Prohibited Activities

Users agree not to:

• use the Platform for unlawful, fraudulent, or unauthorized purposes

• violate applicable Philippine laws or regulations

• upload viruses, malicious code, or harmful software

• interfere with Platform security or operations

• attempt unauthorized access to accounts, systems, or customer data

• use fake identities or misleading information

• harass staff, riders, or other users

Ajly Selection reserves the right to investigate violations and take appropriate action including suspension, cancellation of orders, or legal reporting.

11. Privacy and Data Protection

11.1 Ajly Selection processes personal information in accordance with:

• Data Privacy Act of 2012

• applicable National Privacy Commission regulations

11.2 By using the Platform, you consent to the collection, storage, and processing of your information as described in the Privacy Policy.

11.3 Ajly Selection implements reasonable organizational, physical, and technical security measures to protect customer data.

12. Electronic Communications

12.1 By using the Platform, you agree to receive electronic communications including:

• order confirmations

• receipts and invoices

• delivery updates

• customer support messages

• promotional communications where permitted by law

12.2 Electronic communications shall be considered legally valid under Philippine electronic commerce laws.

13. Marketplace and Third-Party Platforms

13.1 Ajly Selection may sell products through third-party marketplaces, social media platforms, and partner applications.

13.2 Transactions conducted through third-party platforms may also be subject to the policies and terms of those platforms.

14. Limitation of Liability

14.1 To the extent permitted by Philippine law, Ajly Selection shall not be liable for indirect, incidental, or consequential damages arising from Platform use.

14.2 Ajly Selection does not guarantee uninterrupted, error-free, or virus-free operation of the Platform.

14.3 Nothing in these Terms excludes liabilities or consumer rights that cannot legally be waived under Philippine law.

15. Suspension and Termination

Ajly Selection reserves the right to suspend, restrict, terminate accounts, cancel orders, or deny access to users who violate these Terms, engage in fraud, abuse the Platform, or harm the business or other users.

16. Amendments to Terms

Ajly Selection may update these Terms from time to time to reflect operational, legal, or regulatory changes.

Updated Terms become effective immediately upon posting on the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.

17. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.

Any disputes arising from these Terms or use of the Platform shall be subject to the proper courts of the Philippines.
